1.0000 GENERAL TERMS OF AGREEMENT
1.0100 The REVEREND NAME OF CLERIC of CITY, STATE is an INDEPENDENT CLERIC who serves with, but not limited to, the WHITE ROBED MONKS OF ST. BENEDICT of the City and County of San Francisco to carry out as an INDEPENDENT CLERIC various liturgical, sacramental, and educational activities for and within the context of the WHITE ROBED MONKS OF ST. BENEDICT.
1.0101 Given Pastoral Concern, The REV. NAME OF CLERIC, ordained to the Order of (TBD) on MM DD, CCCC, recognizes the MOST REVEREND BISHOP-ABBOT OF THE WHITE ROBED MONKS OF ST. BENEDICT as his incardinating episcopal authority, i.e., Chief Shepherd in the person of Christ, the High Priest, thereby insuring full sacramental integrity (i.e., the unicity of Christ echoed in Father, may they all be one, as you and I are one. (Jn 17:11) of all sacramental services he may provide.
1.0102 We intend, by this article, at allay concerns of some of the People of God who may somehow conclude that a sacrament they receive through the sacramental administrations of a non-incardinated priest/deacon may be some how tainted because that priest/deacon is not functioning within one Church. By this article we assure that a Bishop "enjoys the fullness of the sacrament of orders" and priests and deacons are "dependent upon (the Bishop) in the exercise of authority." (Vatican II Decree on the Bishops Pastoral Office in the Church, n. 15). This article affirms a bishop’s/priest's/deacon's ability (power) to function sacramentally by virtue of ordination. This article further affirms a bishop/priest/deacon is authorized to function sacramentally by the sacramental bond of incardination with one bishop representing Christ, the Head of the Church embodied in jurisdictions, many rooms within the mansion. (Jn 14: 2)
1.0103 Upon completion of all necessary paper work and any other necessary activities, the Bishop-Abbot of the WHITE ROBED MONKS OF ST. BENEDICT will execute an Instrument of Incardination for the REVEREND NAME OF CLERIC.
1.0111 The REVEREND NAME OF CLERIC maintains his clerical residence at: STREET ADDRESS; CITY, STATE, ZIP.
1.0120 The REVEREND NAME OF CLERIC, as an INDEPENDENT CLERIC:
1.0121 pays his own deductions, including self-employment tax as may be the case;
1.0122 assumes legal liability for his work;
1.0123 carries appropriate insurance as may be necessary; and
1.0124 provides for his own liturgical supplies as needed in the performance of his services as an INDEPENDENT CLERIC.
1.0200 WHITE ROBED MONKS OF ST. BENEDICT, whose mailing address is Post Office Box 27536; San Francisco CA 94127, reserves the right to request the services of other independent clerics in carrying out their purposes and objectives.
1.0210 As they appear in the Constitutions of the Order, the objectives and purposes of the Order are:
1.0211 to offer and conduct, without question, religious services for those disenfranchised from their institutional churches of origin in the spirit of brotherly and sisterly Christian love, charity, and compassion within the context of the Old Catholic tradition.
1.0212 to design and implement educational programs promoting wholeness (holiness) for the general public that train, instruct, or educate participants in the principles of physical, emotional, intellectual, and spiritual well-being.
1.0213 to encourage and facilitate the integration of the physical, emotional, intellectual, and spiritual domain of human beings by promoting meditation practices.
1.0214 to provide a context for those so inclined to practice the Christian life in the school of the Lord's Service by following the Order's Rule of St. Benedict.
1.0215 to offer or sponsor seminars, lectures, workshops for ordained clergy desiring to change from one religious jurisdiction or another, providing them an religious context for them to actively serve the People of God as a clerics if they so choose.
1.0220 The Mission Statement of the WHITE ROBED MONKS OF ST. BENEDICT, therefore, is:
1.0221 to engender an atmosphere for healing the human experience
1.0222 wherein each person may realize his or her wholeness, holiness.
1.0223 The WHITE ROBED MONKS OF ST. BENEDICT accomplish this end
1.0224 through the administration of the word and sacraments
1.0225 to all, without question, who wish to participate in them
1.0226 and by offering educational programs
1.0227 through which each may recover the wealth of one's divinity in humanity and humanity in divinity.
1.0230 Thus, it is the mission of the WHITE ROBED MONKS OF ST. BENEDICT to assist the actualization of Christ's prayer: Father, I pray...that all may be one, as you, Father, are one in me and I in you; I pray that they may be one in us...that their unity may be complete. (John 17:20-23)
1.0231 Thus, may the People of God realize Christ's peace, which is not of the world. (Jn 14:27) Hence, as Christ's joy is in them, their joy may be complete, (John 15:11) because they are positioned carry out Christ's command to them: to love one another. (John 15:17) and, consequently, be compassionate as (our) Father is compassionate. (Luke 6:36)
2.0000 FINANCIAL AGREEMENTS
2.0010 The REVEREND (NAME OF CLERIC) agrees to present the WHITE ROBED MONKS OF ST. BENEDICT with an invoice for services performed within the context of the WHITE ROBED MONKS OF ST. BENEDICT when he receives a donation in the form of a check made payable to WHITE ROBED MONKS OF ST. BENEDICT or WHITE ROBED BENEDICTINES.
2.0020 The WHITE ROBED MONKS OF ST. BENEDICT agree to reimburse the REVEREND (NAME OF CLERIC) as per invoice instructions.
2.0100 The REVEREND NAME OF CLERIC may agree to donate to the WHITE ROBED MONKS OF ST. BENEDICT five percent (5%) (10% in San Francisco Deanery with an additional suggested donation to cover admin costs) of the donation he receives in the form of cash or check made payable to him as his own free-will response for the services he renders within the context of the WHITE ROBED MONKS OF ST. BENEDICT. (Upon receiving appropriate tax advise from a competent source, he may then deduct this donation either as a charitable donation or as a business expense as may be appropriate.)
2.0200 The WHITE ROBED MONKS OF ST. BENEDICT will invoice The REVEREND NAME OF CLERIC for printed materials and handling the Monks supply to assist The REVEREND NAME OF CLERIC in fulfilling purposes and objectives of the WHITE ROBED MONKS OF ST. BENEDICT when he is administering within the context of the WHITE ROBED MONKS OF ST. BENEDICT. (c.f. 3.0000)
2.0300 Non-commingling and Non-responsibility
2.0310 It is agreed that any businesses, business related activities, personal and real property WHITE ROBED MONKS OF ST. BENEDICT are and remain their sole property and are completely separate from this Ministerial Services Agreement and that The REVEREND NAME OF CLERIC has no interest or claim in same.
2.0311 The WHITE ROBED MONKS OF ST. BENEDICT have no interest in and receive no compensation from any of The REVEREND NAME OF CLERIC'S businesses, related business activities, real or personal property and have no liability or responsibility for the conduct of The REVEREND NAME OF CLERIC'S activities regarding same businesses, including The REVEREND NAME OF CLERIC'S conduct and the results of his conduct when administering within the context of the WHITE ROBED MONKS OF ST. BENEDICT.
2.0312 It is agreed that any businesses, business related activities, personal and real property of The REVEREND NAME OF CLERIC are and remain his sole property and are completely separate from this Ministerial Services Agreement and that the WHITE ROBED MONKS OF ST. BENEDICT have no interest or claim in same.
2.0313 The REVEREND NAME OF CLERIC has no interest in and receives no compensation from any of the WHITE ROBED MONKS OF ST. BENEDICT businesses, related business activities, real or personal property and has no liability or responsibility for the conduct of The WHITE ROBED MONKS OF ST. BENEDICT activities regarding same businesses, including the conduct of any other monk or CLERIC administering within the context of the WHITE ROBED MONKS OF ST. BENEDICT and the results of that monk's or CLERIC's conduct when administering within the context of the WHITE ROBED MONKS OF ST. BENEDICT.
2.0320 It is understood and agreed upon that by signing this Ministerial Services Agreement, all parties thereto are unconditionally responsible for their own personal integrity or lack of it and take full and absolute, unconditional personal responsibility for their personal, social, moral, financial, priestly, and spiritual integrity.
3.0000 INTENTIONALITY OF THIS AGREEMENT
3.0100 The REVEREND NAME OF CLERIC agrees to support the intention to carry out his clerical activities when administering within the context of the WHITE ROBED MONKS OF ST. BENEDICT the Spirit of the Order as expressed in its purposes and objectives (c.f. 1.0210) and mission statement (c.f. 1.0220).
3.0110 The REVEREND NAME OF CLERIC agrees to support the intention to listen to the Lord speaking to him as He may. The REVEREND NAME OF CLERIC, in principle, supports obedience by listening through (ob + audiens) his perceptions (illusions), beliefs (delusions), and stories (allusions) when administering within the context of the WHITE ROBED MONKS OF ST. BENEDICT and by acting accordingly.
3.0120 The REVEREND NAME OF CLERIC agrees to support the intention to evidence Christ's two commandments: love God, love neighbor when administering within the context of the WHITE ROBED MONKS OF ST. BENEDICT.
3.0121 The REVEREND NAME OF CLERIC agrees to support the intention to adopt a clerical approach that is fluid rather than flexible or inflexible. Being fluid, the REVEREND NAME OF CLERIC takes the shape of the container (the wants and needs of the people he serves within the context of the WHITE ROBED MONKS OF ST. BENEDICT) while maintaining his own integrity and serving thusly.
3.1300 The REVEREND NAME OF CLERIC, thusly agrees to respect the orderly process by:
3.1310 contacting The People within 72 hours that they receive a confirmation letter.
3.1320 presenting in-hand to each couple a OSB/Wedding packet.
3.1330 maintaining one's own individual Activity Log.
3.1340 not speaking about, unless asked directly by The People, nor publishing a "suggested donation" on a web site.
3.1350 filing necessary docs within three (3) days of an event.
3.0140 Water in a cup, a cruet, a vase, a straw is still water. The REVEREND NAME OF CLERIC maintains the intention to offer the people he serves within the context of the WHITE ROBED MONKS OF ST. BENEDICT an opportunity to be again at peace with themselves and God (whomever or however one may or may not conceive God).
3.0150 The REVEREND NAME OF CLERIC agrees to support the intention to have as his goal when administering within the context of the WHITE ROBED MONKS OF ST. BENEDICT the goal of all religion: to close that gap between the individual and God, that sense of alienation or separation.
4.0000 EFFECTIVE DATE OF AGREEMENT
4.0010 The effective date of this memorandum of agreement shall be the ______________ day of ___________, 20___.
4.0020 This memorandum shall continue in effect for the term necessary as stipulated herein.
5.0000 DURATION AND TERMINATION OF AGREEMENT
5.001 Both parties agree that this agreement will remain in effect until terminated by either party.
5.0020 Either party may initiate termination of this agreement with a thirty (30) day written notification, subject to completion of any scheduled liturgical or sacramental activities previously agreed upon.
5.0021 Both parties agree to amicably terminate this Ministerial Services Agreement when necessary.
5.0030 On the termination of this contract pursuant to the term hereof, or as the result of the mutual agreement of both parties hereto, or the death or incapacity of either or both parties hereto, or the impossibility of performance caused by the failure of a party to contribute as agreed, or the bankruptcy or insolvency of any party, or for any other reason, the Ministerial Services Agreement shall be dissolved and wound up in accordance with the provisions of the Uniform Partnership Act, Corporations Code Section 15001, et seq.
5.0031 In any action between the parties to enforce any of the terms of this agreement, the prevailing party shall be entitled to recover expenses, including reasonable attorney's fees and costs of any court action.
5.0100 Upon termination of this agreement and the completion of last previously scheduled sacramental function the REVEREND NAME OF CLERIC is to perform under the aegis of the White Robed Monks of St. Benedict, any of their Instruments of Incardination and related instruments will automatically become Null and Void.
6.0000 ARBITRATION OF DISPUTES
6.0100 Any dispute or claim in law or equity arising out of this Ministerial Services Agreement or any resulting transaction shall be decided by neutral arbitration in accordance with the rules of the American Arbitration Association, and not by court action except as provided by California law for judicial review of arbitration proceedings.
6.0110 Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
6.0120 The parties shall have the right to discovery in accordance with Code of Civil Procedure #128xx 3.05.
6.0200 The following matters are excluded from arbitration hereunder:
6.0201 (a) a judicial or non-judicial foreclosure or other action or proceeding to enforce a deed of trust, mortgage, or real property sales contract as defined in Civil Code #2985,
6.0202 (b) an unlawful detainer action,
6.0203 (c) the filing or enforcement of a mechanics lien,
6.0204 (d) any matter which is in the jurisdiction of a probate court, or
6.0205 (e) an action for bodily injury or wrongful death, or for latent or patent defects to which Code of Civil Procedure #337.15 applies.
6.0300 The filing of a judicial action to enable the recording of a notice of pending action, for order of attachment, receivership, injunction, or other provisional remedies, shall not constitute a waiver of the right to arbitrate under this provision.
7.0000 AMENDMENT OF THIS AGREEMENT
7.0010 This agreement may be amended at any time and in any fashion by further agreement of the parties executed in writing.
8.0000 EXECUTION OF THIS AGREEMENT
8.0010 EXECUTED in San Francisco, California, on the _____________ day of __________, 20____ and in (CITY, STATE) on the _____________ day of _________, 20____.
